Definitions
Event Contracts
means any agreement, contract, or transaction that constitutes a “swap” as defined in Section 1a(47) of the Commodity Exchange Act (7 U.S.C. § 1a(47)) and that provides for any purchase, sale, payment, or delivery that is dependent on the occurrence, nonoccurrence, or the extent of the occurrence of an event or contingency associated with a potential financial, economic, or commercial consequence, including contracts commonly referred to as “event contracts” or “prediction market contracts,” that are listed for trading on a designated contract market (“DCM”) registered with the CFTC.
Sports-Based Contracts
means Event Contracts or prediction market contracts that are based on, related to, or derived from (i) the outcome, score, point spread, or performance of any professional, collegiate, amateur, or esports sporting event or athletic competition, (ii) the individual or collective performance or statistics of any athlete, team, or participant in any such event, or (iii) any component, prop, or derivative measure thereof, including without limitation game outcomes, player props, team props, and over/under totals.
Roles
FCM performs cashiering functions for IB accounts for the receipt and delivery of securities, commodities, making and receiving payments for transactions.
Introducing Broker (IB) is registered with the Commodity Futures Trading Commission under the Commodity Exchange Act, as amended, and is a member of the National Futures Association.
IB is to introduce accounts to an FCM on a fully disclosed basis for the purpose of obtaining execution, clearing and other services relating to transactions in regulated Event Contracts. IB shall abide by procedures established by the FCM for the transmission of orders for the accounts.
User Onboarding
Using Antisso's KYC technology, the IB shall furnish the FCM with the account name, address, social security number and/or tax id number, birthdate, principal occupation, bank account title, address, telephone number, and bank account number at each bank with which the account owner has a bank account from which funds may be deposited with the IB/FCM, and any changes in such banking information.
Prior to opening an account, IB shall have satisfied all applicable rules, including NFA Compliance Rule 2-30, including acquainting itself sufficiently with the personal circumstances of each customer to determine what further facts, explanations and disclosures are needed in order for that particular customer to make an informed decision whether to trade.
Geographic and Regulatory Restrictions
Using Antisso's geo-blocking technology, the IB shall not offer, solicit, or facilitate Event Contracts (including Sports-Based Contracts) to customers located in, or residents of, any state, territory, or jurisdiction in which such activity is prohibited, restricted, or subject to licensing or other regulatory requirements that have not been satisfied. IB is responsible for monitoring and ensuring compliance with all such prohibitions and restrictions on an ongoing basis.
Surveillance Obligation
IB shall operate the Antisso surveillance tools, systems, and procedures designed to detect, investigate, and report insider trading, market manipulation, front-running, wash trading, and other unusual or suspicious trading activity in connection with Event Contracts.
Enhanced Surveillance Obligation
IB shall operate the Antisso enhanced surveillance service designed for sports-related trading, including but not limited to: (i) monitoring for trading patterns that suggest the use of material nonpublic information regarding sporting events, athletes, coaches, officials, or other persons in a position to influence the outcome of a sporting event; (ii) monitoring for coordinated or suspicious trading activity proximate to the start time of a sporting event or following injury reports, lineup changes, or other market-moving information; (iii) screening accounts against publicly available lists of individuals prohibited from sports wagering or subject to sports integrity restrictions (including athletes, coaches, officials, and their close associates); and (iv) maintaining records sufficient to reconstruct trading activity in Sports-Based Contracts for a period of not less than five (5) years.
Continuous Event Contract Disclosures
The FCM may provide the IB with risk disclosures, educational materials, legal disclaimers, consent forms, or other disclosure documents relating to Event Contracts and/or Sports-Based Contracts and the IB shall obtain and record each accounts affirmative assent using Antisso's technology.
